מִידֵּי אִירְיָא? דַּעֲרַבְיָא אַתְרָא, הָכָא — בָּטְלָה דַּעְתּוֹ אֵצֶל כׇּל אָדָם!

The Gemara rejects this answer: Is this comparable? Arabia is a place, and a custom practiced in an entire country is significant. Here, with regard to the practice of the house of Menashya bar Menaḥem, who was an individual, his opinion is rendered irrelevant in relation to the public sentiment.

האמנה כי לדעתי אין דבר השבועה הזאת כמו שחשבו רבים ואין קיום ונצחיות ברית השם יתעלה ואהבתו עם האומה הזאת תלויין בחומרתה אבל הוא קיום ודבוק טבעי הכרחי גדול וחזק ממנו לא ישוער בטולו בשום צד וענין בעולם. והוא מה שיחייב חק וטבע כל נמצא שלא להפרש מחייו ומה שישים ברית כרותה לכל ב"ח שלא יאבד את עצמו שזה אם ישוער באחד מעיר וברוב הימים להפסד דמיונו יעבור החוק ההוא ויאבד את עצמו הנה באמת לא ישוער אפשרותו על כל אישי אותו המין וכמו שאמר בטלה דעתו אצל כל אדם (פסחים מ"ד.) וכן על זה האופן עצמו לא ישוער אפשרות הנזר האומה הזאת מאלהיה וממצותיו וחקיו בשום פנים כי הוא חק מוטבע בהם יותר חמור ויותר חזק משבוע'. וכדי שיתבוננו בו רבים נעריך עליו משל נאות ומסכים לפי ענינו. הרימותי בחור מעם פקח ובעל זרוע בפקחותו עקב אנשים ובאונו שרה על נגידים על כן שנאו אותו שרים רבים וישטמוהו בעלי חצים ולא מצא מנוח לכף רגלו עד שבא להסתופף בחצר בית המלך לחסות תחת כנפיו וישנס את מתניו להתחזק בעבודתו ושמירת ביתו ועשה כרצונו והצליח עד שנשא חן בעיניו ויט אליו חסד ויאמר לו עמוד על משמרתך והזדרז על עבודתך ואשימה עיני עליך להצילך מכל אויביך הקמים עליך ועוד אתן לך עושר ונכסים לרוב ואגדיל את כסאך למעלה וכבוד על כל השרים ואתנה בריתי על כל הדברים האלה ביני וביניך ובין זרעך עד עולם רק אם ישמרו בניך את דרכם ללכת אחריך בכל עבודת הבית ומשמרתו והשבע על הדבר הזה. וישמע הבחור וייטב בעיניו וישתחו לפניו וקבל עליו עבודת המלך ופקידות ביתו עם כל תנאיו ויעבוד אותו הוא ובנו ובן בני והצליחו בעבודתו ויגדלו עד מאד ובנו ערים וישבו והרבו עבדים ויקבצו עושר וכבוד ונכסים עד כי חדל לספור. ודור רביעי או חמישי כאשר שמנו עשתו מאסו בעבודת המלך ומשמרת ביתו מיאנו בשירותו ויפרו בריתו ומיחו במה שעשה אביהם הראשון מקבלת עול מלאכת המלך ושבועתו ופקפקו בה לאמר מי נתן כח ביד אבינו למכור אותנו ביד המלך לצמיתות הלא לנו ולבנינו רשות ויכולת לשוב מאחריו ולעזוב עבודתו והיינו נקיים מאלתו. ויאמר להם המלך עתה כדבריכם כן הוא אמנם אם הנקה תנקו מהיות עבדים לפני גם אנכי נקיתי הפעם מכל מה שהבטחתי לכם בנדרי וכל מוצא שפתי וילכו לדרכם גם המלך נסתלק מעליהם ויעבור כרוז בכל מלכותו כי האנשים ההמה אינם תחת משמרתו ושלא יטלו עוד פרס מאתו גם העביר מהם כל כבודו וישמעו כל השרים אשר היו אויביהם מלפנים ויקומו עליהם ויהרגו אנשיהם וילחמו בעריהם ויקחו את כל ארצם מידיהם ויבוזו את כל שללם עד אשר אבדו מן הארץ ורובם גועו והנשארים בהם דלו מאנוש נעו ועתה האמור תאמר למלך בליעל לומר שהענישם כל זה העונש על שסרו מעבודתו בהיות לאל ידם לסור אחר שלא היה כח באביהם להחליט אותם לעבודה ההיא. ודאי לא. כי הוא לא הענישם על סורם מעליו כלל אבל אולתם תסלף דרכם בסורם משותפות המלך אשר יסד אותם אביהם כי הם פירשו ממנו והנה גם הוא פירש חסדו וטובו מהם. והנה לזה א"א לשער בשום בעל שכל שיסכים בדעתו לבטל החברה והשותפות הזה ולהפר בריתה בשום צד אבל חוייב שברית כזאת אם תהיה במציאות לא תופר לעולם כמו שהוא ברית כרותה על כל בעל שכל שלא יאבד נכסיו ושלא יהרוג את עצמו וכ"ש שיוחזק ויתקיים טבע זה הענין חזוק וקיום נצחי בהיות אנשי הברית רבי המספר מאד כעם גדול או אומה שלמה אחת וכן בעינו הוא ענין קורבת האומה הזאת אל האל יתעל' בלי ספק כי הנה יעקב אבינו בחור מהאבות מתחלתו עקב את אחיו שתי פעמים ובאונו שרה עם גדולים עד שנשטם מעשו ויברח שדה ארם ועם לבן גר ובו התקוטט ובשובו נעכר להבאיש ביושב הארץ הכנעני והפרזי ולא היה לו מנוח מפניהם כי אם בבוא לחסות תחת כנפי השכינה כמ"ש לאל הענה אותי ביום צרתי ויהי עמדי בכל הדרך אשר הלכתי (ברא' ל"ד). והנה לפי שישרו מעשיו ועבודותיו לפני אלהיו הבטיחו לשמרו מכל אויביו ולהצליחו בכל דרכיו וכרות עמו הברית ואת בניו עמו לדור דור כמו שאמר והנה אנכי עמך וגומר (שם כ"ח) וכל הפרשה כלה תחלה וסוף. אמנם הברית הזאת טס כל תנאיו ביאר אותה באר היטב לבני בניו אם במעמד הר סיני באמרו ועתה אם שמוע תשמעו בקולי וגו' והייתם לי סגלה מכל העמים וגומר ואתם תהיו לי ממלכת כהנים וגומר (שמות י"ט) ויותר מבואר בפרשיות הבריתות ובמה שנתבאר באומרו ויי' האמירך היום להיות לו לעם וגומר ולתתך עליון על כל הגוים אשר עשה לתהלה וגומר (דברים כ"ו) סוף דבר כל התורה תבא ותעיד כי בהיות ישראל על משמרתם ומעמדם גם הוא יהיה בעזרם וישמור אותם וינשאם וינטלם עד העולם וכל זה בתנאי כפול וחזק מאד. אמנם אם ישוער שזאת האומה וכל אנשיה יחדיו יבערו ויכסלו לסור מאחרי יי' ולקרא תגר על האבות הראשונים אשר הביאום בברית הזאת וימאנו בו לאמר אי אפשנו בו ולא בתורתו ויען זאת יסלק השם מהם חברתו והשגחתי ויעזבו למה שימשך להם מהשנאה הקדומה מהתקוממות האויבים הרבים לאכול אותם בכל פה ואין עוזר כמו שאמר הכתוב בפירוש ויעזבו את ה' ויעבדו לבעל ולעשתרות ויחר אף ה' בישראל ויתנם ביד שסים וישסו אותם וימכרם ביד אויביהם מסביב ולא יכלו עוד לעמוד לפני אויביהם (שופטים ב') והוא מה שיתמיד הוראתו בכל ספר שופטים. והוא אומרו ע"י ירמיה כי הנני קרא לכל משפחות ממלכות צפונה נאם יי' ובאו ונתנו איש כסאו וגומר (ירמי' א') כי אחר שהעביר כרוז שאינם תחת משמרתו הרי הם קרואים מעצמם וכח אין בידם לעמוד כי הנה הנם כעץ הגפן בין עצי היער כמו שזכרנו בשער פ"ד ובהרבה מקומות נמצא כזה וכזה. והנה כאשר ישמידום ויכלום לא יאמר ודאי שבעונש ההסרה מעליו הגיע להם כל זה השיעור מההפסד אבל חוייב להם זה מסורם מעליו בלי ספק. והיא הוא עקר הברית והאלה אשר לא תופר לעולם. כי לא ישוער לאומה שתבחר בסורה מעל אלהיה בשום פנים כמו שישוער שיבחרו כל אנשים ליחנק יום אחד ומה שאינו בחק טבע האדם לעשותו הנה הוא נחשב לנמנע גמור בחקו כמו שהוא ברית כרותה לעולם שלא יתבטלו אנשיו כלם מצד בחירתם בבטול פריה ורביה וכיוצא אע"פ שאפשר שאחד מעיר יבחר לעשות ולזה היתה הברית הכרותה בינינו ובינו ית' ברית עולם אשר לא תשוער הפרתו בצד מהצדדים. וכבר נמצא הענין הזה מוזכר בהגדה (שבת פ"ח.) במה שאמר מלמד שכפה עליהם ההר כגיגית ואמר אם תקבלו את התורה מוטב ואם לאו שם תהא קבורתכם אמר רב אחא בר יעקב מכאן מודעא רבה לאוריתא והשיבו כבר קבלוה בימי מרדכי דכתיב קיימו וקבלו היהודים עליהם ועל זרעם ועל כל הנלוים עליהם ולא יעבור להיות עושים את שני הימים האלה ככתבם וגומר. הלא תראה כי רב אחא בר יעקב הורה על ענין זה הערעור והפקפוק לא לבנים לבד מהטעם שאמרנו כי גם לאבות עצמם בטענת אונס והכרח שהוא ערעור יותר חזק. והיתה התשובה כבר קבלוה בימי מרדכי ירצ' שלא מכח השבועה ההיא עמדו עליה כי אם מהכרח חיותם שהיא חומרא יתיר' הימנה שאז ראו והכירו שאם ישוער להם לצאת מתחת ידו ומשמרתו יתעלה היו כלם נכונים להשמד להרג ולאבד רגע אחד. שהפורש ממנו הוא פורש מן החיים ולזה קיימו מה שקבלו הראשונים והכוונה אל השואל ואל המשיב להורות שברית התורה והמצוה לא תופר לשום טענ' בעולם שאם לא קובלה מהראשונים היה מן ההכרח לקבלה בכל דור ודור להכרחיות מציאותם ולפי ההוראה הזאת קיימו וקבלו היהודים עליהם בכל תוקף לעשות הימים ההם לעולם כי ימי הפורים האלה לא יעברו מתוך היהודים וזכרם לא יסוף מזרעם. וכבר נתבאר במאמר לא את אבותינו כרת ה' את הברית הזאת כי אתנו אנחנו אלה פה היום כלנו חיים בשער פ"ט שהכוונה בו בהכרח להורות שמציאות התורה וצרכה לא היו בבחינת האנשים ההם שקבלוה מצד עצמם אבל היה צורכם מצד שהיו חיים לשעה ההיא וכן נמשך הכרחיותה לכל אשר ימצאו בחיים בכל זמן כי עץ חיים היא למחזיקים בה כמו שנתבאר זה שער פ"ט עיין עליו והנה אם כן כל מי שהוא בחיים בכל הדורות הנמשכים הם בכלל הברית הזאת עד עולם על הדרך שאמרנו והנה על זה האופן היה זה החבור והדבוק קיים טבעי אי אפשר להנתק לעולם כמו שהיה ענין הברית אשר כרת השם יתעלה עם העולם שלא להביא עוד מבול על הארץ כי שם באמת עקר הברית וקיומו על פי היושר האלהי היה לבלתי תמצא עוד הסבה אשר בעבורה היה ראוי להביא מבול לעולם כי הוא לדעתי אמתת סוד ברית הקשת הנרא' בענן ביום הגשם למבינים אותו כמו שכתבתי במקומו ולדמיון והקשר אלו שני הענינים אמר ישעי' הנביא כי מי נח זאת לי אשר נשבעתי מעבור מי נח על הארץ וגומר כי ההרים ימושו והגבעות תמוטינה וחסדי מאתך לא ימוש וגו' (ישעי' נ"ד). כמו שנתבאר זה יפה בסוף שער י"ד דרוש משם כי הוא ענין נכבד מאד ועל פי הענין הזה יהיה מאמר אם ימשו החקים האלה מלפני נאם ה' גם זרע ישראל ישבתו וגומר (ירמיה ל"א). והכונה כי כמו שלא ישוער יכולת השם על ביטול חקי שמים וארץ לא מפני שאינו יכול אבל שלא ישוער ירצה בו בשום פנים. כן לא ישוער שתשבות האומה הזאת מהיות לפניו כל הימים לא מפני חומר השבועה והאלה אשר קיימו האבות הראשונים עליה כי אם מפני שלא יתואר אפשרות הסכמתם על ביעולה בשום פנים. ומזה הענין עצמו הוא מה שסמך לאמר (שם) אם ימדו שמים מלמעלה ויחקרו מוסדי ארץ למטה גם אני אמאס בכל זרע ישראל על כל אשר עשו נאם ה'. כי הנה באמת שמים לרום וארץ לעומק בעלי שיעור ומדה הם מפאת עצמם אבל יאמר שאין להם שיעור ומדה לפי שלא נמצא מי שישערם וימדדם על אמתתם כמו שכתבנו זה בסוף פרשת מילה שער י"ח. וזהו בלי ספק סוד מאמר את אשר ישנו פה עומד היום לפני ה' אלהינו ואת אשר איננו פה עמנו היום כי כמו שאמרנו ברית כרותה אל הכלל שלא יסכימו על הריגת עצמם שהוא ענין טבעי יותר חזק מחמרות השבועה אשר חשבוה כלל האנשים כי השבועה ההיא כבר היו אפשריים לעבור עליה וזאת לא סרה ולא תסור לעולם:

If we interpret the above to mean that Israel will be physically unable to break the covenant of its forefathers, the fact that throughout the ages large segments of our people have always defied the rules of the Torah, is mystifying. Also, if we cannot contravene the laws of the Torah physically, what about the concept of free will upon which the entire system of reward and punishment is built? Again, if G'd feels compelled to threaten retaliation for nonobservance of His laws, there evidently cannot be a question of physical inability to transgress these laws! Furthermore, if G'd had the power to make us live up to the covenant, threats of chastisement seem pointless. From all the above, we feel that it is clear that the matter of the oath needs to be understood somewhat differently from the manner most commentators have presented it. We must also subscribe to the notion that the eternal existence of the Jewish people as well as their special status amongst the nations is not tied to the observance or non observance of the covenant, but rather that it is anchored in the very nature of this people, which will not change even when defying the covenant. Although the impulse for self-destruction is abnormal, unnatural, G'd has seen fit to legislate against the commission of suicide, assuming that such legislation might dissuade a few people bent on self-destruction. The rare phenomenon of wilful self-destruction does not undermine the will of the vast majority to remain alive. Similarly, the estrangement of the nation from its G'd cannot be brought about by the desertion of a few, since the bond tying it to its G'd is far too deeply rooted in history. The following parable will illustrate the whole subject more clearly. A certain highly intelligent and courageous young man who successfully confronted his less highly principled peers, became the object of his peers' hatred. They did everything to make the young man's life unbearable until the young man sought refuge at the King's Court. There he was placed under Royal protection. The young man thereupon concentrated his abilities and energies on performing a series of duties for the king, until the latter decided to grant him a special status in recognition of his selfless devotion. The king entered into an agreement with the young man whereby his special status would also extend to his descendants, on the understanding that such descendants would keep faith with the king, and would continue to perform the duties assigned to them. The young man was overjoyed by this generous offer, and accepted with alacrity. For several generations the descendants of the young man prospered and kept their part of their ancestor's bargain. The fifth generation, having become extremely wealthy, decided that the services rendered to the king had become too onerous, and refused to carry out the terms of the agreement their forefather had entered into. Their complaint was directed at their forefather, whom they accused of having committed them to a life of servitude to the king. They therefore claimed the right of self determination, and the freedom to decide for themselves whom they would recognise as their Master. The king was quite agreeable, pointing out however, that since the family's obligations were being terminated, so was his own undertaking to grant this family special protection against its natural enemies, and to ensure its continued affluence. As soon as all the former enemies heard about the changed relationship of that family and the king, they resumed harassing the family with devastating results. No one in their right mind would accuse the king of having punished that family. Everyone understands that whatever evil befell that family from that time on had been their own doing, that they had only themselves to blame. Applied to the Jewish people, the comparison is quite simple. Jacob, choicest of our ancestors, had incurred the wrath of Esau, the jealousy of Laban, the enmity of the Canaanites around Shechem, and had led a life of frequent upheavals, daily skirmishes until he took refuge under the wings of the shechinah. (Genesis 35,8) "The Lord who has answered me on the day of my distress." Because his way of life had found favour in the eyes of G'd, He assured Jacob of protection against his enemies, and this support continued throughout the generations, (see beginning of Parshat Vayetze) The promise was spelled out in detail at Mount Sinai, (Exodus 19,5) when the condition "now you must hearken to My voice and observe My covenant etc" was made a prerequisite for this continued protection and special status of the Jewish people. These conditions were further emphasized in Deuteronomy 26,15-19, when the reciprocal relationship between Israel and G'd is repeated in clear and unmistakable language. If subsequent generations would repudiate the deal made by their ancestors by worshipping idols and other acts of disloyalty to their erstwhile king, then the ill fate that would befall them could not be described as punishment by that king. On the contrary, they would be considered the architects of their own misfortune, especially, since G'd is on record as withdrawing the special status this people had enjoyed heretofore. The crucial aspect of the eternal nature of the covenant is, that just as mass suicide committed by a whole people simultaneously is unthinkable, so the alienation of the entire Jewish people from its Torah and its G'd simultaneously, is equally beyond the realm of possibility. When the Talmud in Shabbat 88, discusses the coercion used by G'd in order to get the Jewish people to accept the Torah at Sinai on pain of immediate burial under the Mountain, Rabbi Acha bar Yaakov raises the issue of the validity of acceptance under duress. This issue is raised concerning the people standing at the foot of the mountain. How much more would this question apply to later generations who had not even been present on that occasion! Those later generation who had not experienced liberation from bondage in Egypt, had far less reason to accept the Torah out of a sense of gratitude for their deliverance! The argument in the Talmud is turned aside by a reference to the Jewish people accepting Torah completely voluntarily at the time of their deliverance from the threat of extinction by Haman. That acceptance is deemed binding for all future generations. That so-called voluntary acceptance was induced by the realisation that if G'd were to forsake them, their very existence would come to an end, as had been demonstrated by their experience with Haman. The latter had almost succeeded in wiping out a nation that had considered itself both secure and emancipated. When the wording of the covenant in Parshat Nitzavim stresses that the covenant did not only apply to the generation of the Exodus, but to all subsequent generations, the reference to the generation of the Exodus teaches that even that generation did not have to accept Torah out of a sense of gratitude, but rather because Torah had become a natural habitat for the Jewish people, just as water is for fish or blood for the body. "She is a tree of life to those who support her." (Proverbs 3,18) Just as G'd had promised never to bring another deluge, since conditions would not be allowed to recur which would call for such mass extinction, so conditions allowing a total rupture between Israel and its G'd would also not be allowed to recur. This is what the oath in our Parshah wishes to convey. Jeremiah 31,16, quoted earlier, describes a situation which is possible in theory, since all physical phenomena have measurable finite dimensions. Since the effort in actually taking those measurements is mind boggling, so is the idea of G'd despising the entire Jewish people. Isaiah 54, 9-10, may be understood in a similar vein.
